The new National Disability Advocacy Framework 2023-2025 (NDAF) and associated Disability Advocacy Work Plan were endorsed by Disability Ministers on 21 April 2023. They were developed by the Australian, state and territory governments, in consultation with people with disability, families, carers, disability advocacy providers and disability representative organisations. The NDAF commits governments to work together to improve national consistency and access to advocacy services for people with disability across Australia. The Work Plan identifies shared priority work areas for the Australian, state and territory governments, to work on to support the outcomes in the NDAF.

The Determination 2023 sets out the rules decision-makers must use when assessing a person’s work-related impairment for the Disability Support Pension (DSP) under the Social Security Act 1991. A number of changes were made to the DSP assessment that apply to claims for the DSP made on or after 1 April 2023. The number of tables have been reduced from 22 to 15. The new tables adopt a functional-based assessment of a person’s ability to work, instead of the previous diagnosis-based assessment. This instrument replaces the 2011 Determination.

Different types of home and living supports will suit different people. Specialist disability accommodation has been designed to meet the needs for people living with disability who have very high support needs. Most participants don’t need to live in specialist disability accommodation, and there may be other home and living supports that better suit your needs and preferences. The guidelines will clarify what options are available to you and how to get specialist disability accommodation into your budget if you are eligible.

The National Disability Insurance Scheme Amendment (Participant Service Guarantee and Other Measures) Act 2022 passed both houses of Parliament on 30 March 2022 and received Royal Assent on 1 April 2022. This amendment to the NDIS Act 2013 establishes the Participant Service Guarantee which will improve the experience and outcomes for people with disability who engage with the Scheme.

If you’re 18 or older, you have the right to make decisions about your business with the NDIS. If you’re not able to make decisions, even with support, you will need representative decision-making. The person undertaking this role is called a nominee and they do this voluntarily. The guidelines provide consistency and transparency about how nominee decisions are made and explain the nominee roles and responsibilities.
