NDIS legislation amendments 2022

The National Disability Insurance Scheme Amendment (Participant Service Guarantee and Other Measures) Act 2022 passed both houses of Parliament on 30 March 2022 and received Royal Assent on 1 April 2022. This amendment to the NDIS Act 2013 establishes the Participant Service Guarantee which will improve the experience and outcomes for people with disability who engage with the Scheme.

Guideline for appointing a nominee

If you’re 18 or older, you have the right to make decisions about your business with the NDIS. If you’re not able to make decisions, even with support, you will need representative decision-making. The person undertaking this role is called a nominee and they do this voluntarily. The guidelines provide consistency and transparency about how nominee decisions are made and explain the nominee roles and responsibilities. They also provide information about agency-initiated appointments

Vehicle modifications and driving supports guideline

The guidelines for vehicle modifications and driving supports has recently been updated. It includes information on which modifications and supports are funded by the NDIS and the information and assessment required to receive them. Inclusive Victoria: state disability plan (2022–2026

The state disability plan (2022–2026) is Victoria’s plan for making things fairer for people with disability. The plan is a key way for the Victorian Government to be accountable for making all parts of the community inclusive and accessible for everyone. The Disability Act 2006 (Vic) requires a new state disability plan to be developed every four years. The plan sets out actions that will help the Victorian Government meet its obligations under the United Nations Convention on the Rights of Persons with Disabilities. It is also the implementation plan for achieving outcomes under Australia’s disability strategy (2021–2031).

Australia’s Disability Strategy 2021-2031

The Strategy) is a national framework that all governments in Australia have signed up to. It sets out a plan for continuing to improve the lives of people with disability in Australia over the next ten years.  The Strategy supports Australia’s commitment under the United Nations Convention on the Rights of Persons with Disabilities. The Strategy’s vision is for an inclusive Australian society that ensures people with disability can fulfil their potential as equal members of the community.

NDIS Operational Guidelines

Operational Guidelines are based on the NDIS Legislation and Rules. They explain what is considered, and how decisions are made based on the legislation. The new guidelines are written in plain English to make it clearer and easier to understand NDIS processes in a more logical way. The new sets of guidelines include ‘How NDIS supports work’, ‘Supports you can access’ and ‘Your plan’.

Regulated Restrictive Practices Guide

This guide explains what a restrictive practice is, assists in identifying each regulated restrictive practice and provides practice advice consistent with a positive behaviour support framework  and contemporary evidence informed practice, with the intention to reduce and eliminate the use of restrictive practices. 

Younger People in Residential Aged Care Strategy 2020-2025

Closing date: October 1, 2025

The initiative includes $10.6m in the 2020-21 Budget for a national network of system coordinators to help younger people find age-appropriate accommodation and supports to allow them to live independently in the community. The Australian Government is committed to ensuring no younger person (under the age of 65) lives in residential aged care unless there are exceptional circumstances.

Disability Service Safeguards – Code of Conduct

The Code sets out the obligations that all Victorian disability workers must abide by and provides a standard to protect people with disability from harm and abuse. Charter of Aged Care Rights

This single charter of rights across aged care is part of the Single Aged Care Quality Framework and takes effect from 1 July 2019. It replaces the four current charters that relate to care recipients’ rights and responsibilities. The Charter is easy to read and focuses on high-level consumer rights and provides the same rights to all aged care recipients, regardless of the type of care and services they receive.

National Disability Insurance Scheme Amendment (Quality and Safeguards Commission and Other Measures) Bill 2017

An important law was approved by the Government last week – the “National Disability Insurance Scheme Amendment (Quality and Safeguards Commission and Other Measures) Bill 2017. This means there will be a new organisation in the NDIS set up to keep an eye on things to try to make sure NDIS participants are safe from harm. It is called the NDIS Quality and Safeguards Commission.
