The Determination 2023 sets out the rules decision-makers must use when assessing a person’s work-related impairment for the Disability Support Pension (DSP) under the Social Security Act 1991. A number of changes were made to the DSP assessment that apply to claims for the DSP made on or after 1 April 2023. The number of tables have been reduced from 22 to 15. The new tables adopt a functional-based assessment of a person’s ability to work, instead of the previous diagnosis-based assessment. This instrument replaces the 2011 Determination.

The National Disability Insurance Scheme Amendment (Participant Service Guarantee and Other Measures) Act 2022 passed both houses of Parliament on 30 March 2022 and received Royal Assent on 1 April 2022. This amendment to the NDIS Act 2013 establishes the Participant Service Guarantee which will improve the experience and outcomes for people with disability who engage with the Scheme.

An important law was approved by the Government last week – the “National Disability Insurance Scheme Amendment (Quality and Safeguards Commission and Other Measures) Bill 2017. This means there will be a new organisation in the NDIS set up to keep an eye on things to try to make sure NDIS participants are safe from harm. It is called the NDIS Quality and Safeguards Commission.

The Disability Discrimination Act 1992 (DDA) makes it unlawful to discriminate against a person, in many areas of public life, including employment, education, getting or using services, renting or buying a house or unit, and accessing public places, because of their disability. Disability discrimination occurs when a person is treated less favourably, or not given the same opportunities as others in a similar situation because of their disability.

The Charter is a Victorian law that sets out the basic rights, freedoms and responsibilities of all people in Victoria. There is twenty fundamental human rights protected under the Charter and the relationship between government and the people it serves is described. It requires public authorities, such as Victorian state and local government departments and agencies, and people delivering services on behalf of government, to act consistently with the human rights in the Charter.

The Standards were formulated to assist educators understand and comply with their obligations under the Disability Discrimination Act 1992, and became federal law in August 2005. The Standards seek to ensure that students with disability can access and participate in education on the same basis as students without disability.

The Disability Act 2006 is the legislation for people with a disability in Victoria. It replaces the current Intellectually Disabled Persons’ Services Act 1986 and Disability Services Act 1991. It is guided by the principles of human rights, and provides the framework for a whole of government, whole of community approach to improve the social and economic participation of people with disability in the community.
